Extended Warranty Agreement

Clayton Auto Parts & Wrecking, shall warranty "Qualified Parts" to be free from defects in material and workmanship as prescribed in this "Extended Warranty". This is an optional warranty, and must be purchased along with a "Qualified Part". No other expressed or implied warranty shall exist. It is the responsibility of the purchaser to read and understand the terms of this warranty.

The term of the warranty shall be prescribed on the original purchaser's invoice.

Definitions:

  1. "C.A.P."- Clayton Auto Parts & Wrecking
  2. "Engine"- A recycled and tested used engine long block assembly (block, cylinders, cylinder heads, valves, pistons, rings, camshaft, rockers, oil pumps, crankshaft and rods).
  3. "Term"- The term shall be listed on the invoice as a Warranty line item:
    a) "Silver" 6 months: 6 calendar months from original invoice date.
    b) "Gold" 12 months: 12 calendar months from original invoice date.
    c> "Platinum" Lifetime: As long as you own the vehicle
  4. "Qualified Part"- any part C.A.P. agrees to offer an "extended warranty" with.
  5. "Replacement"- To replace, exchange, or repair a part or assembly with a like kind and quality part.
  6. Labor"- Authorized claims shall not exceed 100% of Mitchell or Chilton flat rate time, which ever is less. The price paid for labor shall be at the prevailing labor rate or $40.00 per hour, which ever is less.
  7. "Deductible"- In the event of an "Engine" or "Transmission" claim, the first $50.00 in "Labor" or "Replacement" shall be paid for by the purchaser.
  8. "Authorized Repair"- Any repairs and/or replacements covered by this warranty must be authorized by "C.A.P." s prior authorization.
  9. "Normal Operation"- Normal street legal driving, with properly scheduled maintenance completed.
  10. "Accessories"- Any item that is attached or that has been included with a part or a assembly, including but not limited to: (cooling system, fuel system, exhaust system, electrical system, engine control system, transmission control system, ignition system, belts, hoses, and filter). Any incidental parts that may have been left attached to aid in the ease of installation, which should be exchanged with your original parts at the time of installation. This will assure proper fit and performance. Components provided from the original assembly or part.
  11. "Accident"- Mishaps, mistakes, collisions, improper care, vandalism, theft, or errors.
  12. "Authorized Dealer"- A qualified and approved representative or service provider retained by "C.A.P.".
  13. "Routine Maintenance"- Shall include but not limited to; engine oil & filter changes using SE or better rated motor oil documented every 3,000 miles, tune-ups, valve adjustments, timing belt replacement and adjustments, cylinder head re-torque, filter replacement, cooling system flush. Cooling system fans must be inspected regularly to insure proper operation, and avoid engine overheating. Any maintenance that is recommended by the original manufacturer.
  14. "Overheating"- Operating the product in excess of its normal safe operating temperature range. A heat sensitive tab has been installed to record any exceedance that may have occurred.
  15. "Lack of Lubrication"- An event indicated by scalding, discoloration, or seizing of moving parts.
  16. "Pre-ignition"- Pinging or knocking due to improper fuel, fuel mixture, Valve timing, or ignition timing.
  17. "Purchaser"- The original named purchaser and receipt holder of a part and warranty.
  18. "Do-it Yourself"- Labor performed by someone other than an "Authorized Dealer".
  19. "Interchange"- The use of a part removed from a vehicle of different year, make, model or performance standard. Not an exact match of a part.
  20. "Dealer"- A licensed Garage, New Car Dealer, Collision Repair Center, Body Shop, or Used Car Dealer.

Limitations and Exclusions:
This warranty shall not apply to, or include any of the following:

  1. "Replacement" required as a result of, but not limited to an "Accident".
  2. "Replacement" of parts other than parts that are specifically named on the purchaser's invoice.
  3. "Replacement" required as a result of other than "Normal Use".
  4. Any part that has been repaired, replaced, or altered by someone other than an "Authorized Dealer".
  5. "Replacement" required as a result of the use of any "Accessories"
  6. "Replacement" Required as a result of improper and/or undocumented "Routine Maintenance".
  7. Damage occurring from, but not limited to Damage from "Lack of Lubrication", "Overheating", or "Pre-ignition".
  8. "Replacement" or repairs that do not meet the definition of an "Authorized Repair".
  9. Improper installation or diagnosis.
  10. "Replacement" required as a result of failure to use any "Accessories".
  11. "Replacement" required as a result of "Interchange".
  12. Claims made for incidental, special, consequential, or exemplary damages.
  13. Claims for cost of transportation or travel expenses.
  14. Products that have not been paid for in full prior to any claim.
  15. Claims arising from of an injury or accident.
  16. Racing, off-road, commercial, abusive, and careless operation shall not be covered.

Purchaser/Users Obligations:

  1. Engine oil and filter must be replaced at time of installation.
  2. Engine oil and filter should be replaced every 3,000 miles.
  3. Retain all documentation that will support proper maintenance.
  4. Cooling systems must be inspected for proper and effective operation.
  5. Proper installation is essential to safe and satisfactory operation of this product.
  6. The operator must observe and respond correctly to any indication of failure.
  7. Discontinue operation if you have any indication of "Overheating" or "Lack or Lubrication".
  8. As indicated, a failure to stop operation may result in severe product or vehicle damage.

Limited Warranty:
This warranty is given in lieu of all other warranties, expressed or implied, including any warranty of merchantability, or fitness for a particular purpose, on the part of "C.A.P." or the "Dealer" installing the product. No "Dealer", or any agent or employees thereof, is authorized to extend or enlarge this warranty.

Transfer:
This warranty cannot be traded or transferred, and is no longer in effect if the ownership of the vehicle changes.

Resale:
The "Dealer", who purchased, and installed the product and warranty, may resell this "Extended Warranty" one time. The "Dealer" will be responsible for maintaining proper documentation of the resale.

Claims:

  1. Authorized Repairs" will be paid at the prescribed "Labor Rate".
  2. A "Replacement" will be provided after, properly "Authorized Repairs" have been arranged.
  3. No "Labor" Claims will be paid on "Do-it Yourself" repairs.
  4. Claims for the part will not exceed the amount paid for the part covered under this "Extended Warranty".
  5. Labor on Engines and Transmissions is subject to a $50.00 deductible.

Agreement:
This "Extended Warranty" agreement is binding only if it is purchased on the part in question. The "Purchaser" is responsible for maintaining the original invoice and other records pertaining to this "Extended Warranty".
